Terms and Conditions Acceptance

You accept the Terms and Conditions listed below with regards to the matching service offered by engaging a swimming coach from SwimCoachFinder (also known as SCF herein). When a coaches’ profile has been provided to you through WhatsApp, SMS, or email, or when the swimming coach has conducted the first coaching lesson as scheduled in the respective correspondence with the client, the engagement is formally established.

Payment And Commission

The matching services provided by SCF is free-of-charge for the client as commission is charged to the swimming coach. The client is required to pay SCF for 1 month of lesson fees (or another indicated amount) indicated. You can send the money to SCF via bank transfer, PayNow, or PayLah. The swimming fees paid also reflects the commission that SCF charges to the swimming coach, and client do not need to pay the swimming coach for the first month of swimming fees.

For subsequent payment, the client and swimming coach will agree on the payment schedule which may be sent directly to the swimming coach. Any additional swimming services during the first month, such as teaching the student's siblings, friends and relative, must be disclosed to SCF and is subject to commission. The swimming coach will also be responsible for paying this commission. Any attempts to evade the commission due to SCF (in any manner) are prohibited. Such dishonest and unethical behaviour is categorically not tolerated by our firm.

Time and place of classes 

The swimming lesson will be conducted at the assignment's stated address and time. After the first lesson has been completed, client can discuss changing the lesson schedule with the swimming coach. Unless otherwise agreed upon or mentioned, the lesson will take place at the client's location.

Swimming Coach Profile (Digital Name Card)

The coaching certifications of our swimming coach will be shared via the digital name card in which coaches are responsible for providing accurate information and credential. SCF disclaims responsibility for any lies or misrepresentations made by swimming coaches in the digital name card. Be assured that dishonest swimming coaches are extremely uncommon, and that we have internal processes in place to carry out the essential due diligence to the best of our abilities. If a client discovers a fraudulent swimming coach, please let SCF know so that we may assist you in filing a police report about the fraud.

Cancellation of a Swimming Coach

For cancellation by the client within the first month, SCF will spilt 50% of the total lesson fees with the swimming coach (based on lesson conducted by the swimming coach). The client is responsible for paying SCF the amount shown on the invoice.

In the highly unlikely situation where cancellation of swimming lesson is by the swimming coach due to personal reasons, medical reason etc, the lessons conducted by the swimming coach will typically have to be paid for. To decide if complete payment by the client for the classes conducted is necessary, SCF will take these factors into account on a case-by-case basis. You consent to recognize and abide by SCF's final judgments on these issues by accepting these Terms & Conditions.

Cancellations & Postponement of the first lesson

The client must notify SCF or the swimming coach at least 3-hour notice in advance if the first lesson needs to be postponed or cancelled. Clients are required to pay 50% of the first lesson fees if stipulation of 3-hour notice is not met. The swimming coach and SCF will each receive 50% of this sum to cover the costs of swimming coach's time and transportation, and SCF's service. SCF is aware that last-minute emergencies may cause cancellations, and they will be handled individually.

Bad weather

In the event of a cancellation due to inclement weather, the client must notify the swimming coach at least 3 hours in advance and work out a plan with the swimming coach.

Charges for Late Payment

For outstanding fees payment of one month or more, SCF has the right to charge a late payment fee. After the first month of the grace period, there will be a $50 late payment fee for every two weeks (14 Days) of late payment. Depending on the resources/time required to recover the debt, additional administrative costs might also be assessed. Each situation will be examined individually.

Additionally, SCF has the right to sue for any debt it deems necessary or to initiate a claim with the Small Claims Tribunal. As a guideline, SCF will file a claim with the Small Claims Tribunal if the money is not received within three months of the payment, but it may also decide to do so sooner if it is determined that there is no other way to recover the debt. For every two weeks that no payment is made, late payment fees will continue to be imposed until the court issues its final ruling.

Service Quality

The swimming coaches provided by SCF is not guaranteed to lead to an improvement in the student's swimming ability. However, SCF will make every effort to match clients with the best and most suitable swimming coach who fits their needs and price range. Clients are responsible for paying swimming fees for lessons conducted and can cancel the lesson if the client finds them to be unsatisfactory. Client is welcome to give us feedback on their coaching experience, and SCF will be grateful for it.

To coaches whom sign up for Digital Name Card Services

Ownership and Usage Rights- The template used in creating the digital name card and any customisation during the design process remain the property of SCF. SCF grants the client a license to use the digital name card for personal and professional purposes.

Service Level Agreement - 

Turnaround Time: We commit to delivering your digital name card within 5 working days from the receipt of your payment and working file.

Design Alterations: After receiving the completed design, any requested alterations will be addressed within 5 working days.

Monthly Alterations: SCF allow one design alteration per month. Additional alterations will be accommodated based on our workload and goodwill.

Cancellations by User: Unfortunately, SCFdo not provide refunds for any unused services in case of user-initiated cancellations.

Cancellations by Us: In the event of unforeseen circumstances leading to our cancellation, SCF will refund the unused portion of the service based on the signed-up period.

Disclaimer

SCF strives to create the best possible match between students and swimming coach. If a dispute arises, SCF will intervene to help resolve it, but it will not be held accountable for either party's conduct. Any potential problems and legal disputes will not be the responsibility of SCF. Unless otherwise required by law, SCF has the right to withhold information from any party and to cancel or refuse services to them.

Client

Anyone who contacts SCF to request a swimming coach is referred to as a client. To help with the search, the client's information about the request (location, day & time, lesson frequency, and other information excluding personal information) may be disseminated to swimming coaches. SCF won't disclose the client's complete address or phone number until the session has been confirmed with a swimming coach who has accepted the assignment.

Swimming coach

An individual who registers with SCF for swimming assignments is a swimming coach.To speed up the selection process, clients may be informed of general information pertaining to swimming assignments, such as your qualifications, gender, experience, and other details. Clients won't be informed of personal details like your contact information or full name until the assignment has been confirmed.

Modification of the Terms & Conditions
